1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of SmartRent.ie (the "Platform"), a property management software tool provided by SmartRent.ie ("we", "us", or "our").

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

2. Nature of Service

You retain full control and responsibility for:

• Managing your properties and tenancies
• Screening and selecting tenants
• Collecting rent payments
• Handling maintenance requests
• Ensuring compliance with Irish law

3. Eligibility

To use our Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract
• Provide accurate and complete information during registration
• Not be prohibited from using the Platform under Irish or EU law

4. User Accounts

4.1 Account Creation

You must create an account to use certain features of the Platform. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access

4.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscription and Payments

5.1 Pricing

We offer three subscription tiers:

• Free: Up to 2 properties, basic features
• Pro: €29/month, up to 10 properties, all features
• Enterprise: €99/month, unlimited properties, priority support

5.2 Payment Terms

• Subscriptions are billed monthly in advance
• Payments are processed securely via Stripe
• All prices are in Euro (€) and include applicable VAT
• We may change pricing with 30 days' notice

5.3 Refunds

Refunds are provided on a case-by-case basis within 14 days of purchase, in accordance with Irish consumer protection law.

6. Acceptable Use

You agree NOT to:

• Use the Platform for any illegal purpose
• Violate any Irish or EU laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Use the Platform to harass, abuse, or harm others
• Scrape or collect data from the Platform without permission
• Impersonate another person or entity
• Share your account with others

7. AI-Powered Features

Our AI-powered features (tenant screening, rent pricing, expense categorization) are provided as recommendations only. You are solely responsible for all final decisions regarding:

• Tenant selection and screening
• Rent pricing and adjustments
• Expense categorization
• Property management decisions

Disclaimer: AI recommendations are not guaranteed to be accurate or complete. Always use your own judgment and comply with all applicable laws.

8. Intellectual Property

8.1 Our Rights

The Platform, including all content, features, and functionality, is owned by SmartRent.ie and protected by copyright, trademark, and other intellectual property laws.

8.2 Your Rights

You retain all rights to the data and content you upload to the Platform (property listings, documents, messages, etc.). By using the Platform, you grant us a license to use this content solely to provide our services.

9. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with GDPR.

10. Disclaimers

10.1 No Legal Advice

SmartRent.ie does not provide legal advice. Information provided on the Platform is for general guidance only. You should consult with a qualified solicitor for legal advice specific to your situation.

10.2 No Property Management Services

We do not provide property management services, letting services, or act as your agent. We provide software tools only. You are responsible for all property management decisions and compliance with Irish law.

10.3 Platform Availability

The Platform is provided "as is" and "as available". We do not guarantee that the Platform will be available 24/7 or free from errors. We may suspend or discontinue the Platform at any time.

11. Limitation of Liability

To the maximum extent permitted by Irish law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months
• We are not liable for decisions you make based on Platform recommendations
• We are not liable for third-party services (Stripe, GoCardless, OpenAI, etc.)

Note: Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Irish law.

12. Indemnification

You agree to indemnify and hold harmless SmartRent.ie from any claims, damages, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any law or regulation
• Your violation of any third-party rights
• Your property management decisions

13. Termination

13.1 By You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

13.2 By Us

We may suspend or terminate your account if you violate these Terms, fail to pay, or if we suspect fraudulent activity.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Email notification to registered users
• Prominent notice on the Platform
• Updating the "Last updated" date at the top

Your continued use of the Platform after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of Ireland. Any disputes will be subject to the exclusive jurisdiction of the Irish courts.
